General Terms and Conditions

Potentia Pilates operates a Pilates studio in Shop 1 22 Newmans Rd Templestowe 3106 Victoria, Australia. Please read these Terms and Conditions (the ‘Terms’) carefully, as it is a condition of us allowing you to use our studios, that you agree to our terms and conditions.   

1) Reformer Pilates Classes are limited to a maximum of 12 only and you are requested to adhere to the booking and cancellation policy of the studio to ensure that others have an opportunity to attend should you need to cancel.

2) The Sauna room is limited to two bookings at any given time and you are requested to adhere to the booking and cancellation policy of the studio to ensure that others have an opportunity to attend should you need to cancel.

3) Potentia Pilates does not offer refunds, transfer or offer compensation of any kind for change of mind, injury, illness, change of address or any other reason.  All purchases are final.

4) All passes and memberships are non-transferrable and may not be shared.

5) Bookings are made online via Momence website or App, or in the studio. Payment must be made upon booking.

6) After the expiry of the minimum term, the membership will continue indefinitely until you advise Potentia Pilates via email (hello@potentiapilates.com.au) that you wish to terminate the membership. 2 Weeks Notice to cancel is required and please allow 3 business days to process any such termination.

7) Cancellations and rescheduling classes need to be made more than 5 hours prior to your class with no exception. All late cancellations will incur a lost session.

8) Further and more specific terms and conditions relating to our offers, class session packs and memberships can be found below and at our reception. By purchasing any of these passes or memberships, or attending any class using one of these passes or memberships, you acknowledge and agree that you have read, understood and agreed with those further terms.

9) Potentia Pilates are not responsible for the safekeeping of your belongings.

10) Trainers and classes are subject to change without notice and we reserve the right to cancel classes if necessary due to lack of attendance, instructor availability or any other reason deemed appropriate by Potentia Pilates. Classes require a minimum of 2 people before they proceed.

11)  We take safety seriously and for this reason clients may be requested to provide a medical clearance to participate. The programs are not designed for children and therefore participants must be 14 years and over, likewise children are not permitted in the studio at any time while you participate in any class.

12) Lock-out policy: To maintain our professionalism and to ensure the safety of our clients and their belongings, our studio door will be locked 1-minute after the class start time. This is to ensure that classes aren’t disrupted by late comers as well as encourages our clients to arrive early and complete all necessary paperwork/give the client an opportunity to let the teacher know of any injuries or considerations that need to be accounted for within class. If you arrive after we have locked our doors, you will unfortunately not be able to participate in class so please ensure you always arrive at least 5-minute early, at least 10-minutes early for newcomers.

Pricing, Payment Terms, Returns & Refunds

All prices are quoted in Australian Dollars ($AUD) and all transactions are processed in Australian Dollars ($AUD). Prices, products and offers include GST.

All prices are correct at the time of online publication. Prices are subject to change without notice.

All items are promoted in good faith to be available at the time of ordering. Unforeseen supply problems or unexpected demand may occasionally result in stock or promotions being unavailable.

Sale items are only available at the lower price during the sale period.

We receive the right to amend prices and printing errors.

Pilates is in no way responsible for additional fees that a holder may incur from their bank in relation to processing payment of fees for direct debit Memberships.

All purchases are final. Potentia Pilates does not offer refunds, transfers, suspensions or extensions on services, workshops or products for a change of mind, injury, illness, change of address or any other reason. Potentia Pilates are not liable to refund, transfer or offer compensation of any kind for classes that are unused, late, changed or cancelled for any reason (e.g. sickness, travel etc), or in the event you are unable to attend a class because it is full. 

All passes and memberships are non-transferrable. 

Passes and Memberships may not be shared. Anyone deemed to be in breach of this condition will be denied entry and forfeit their pass and/or membership indefinitely.

Cancellation Policy

If you need to cancel your attendance, please withdraw from the class using your account on the Momence app or website. Unfortunately we can’t accept cancellations by phone, email or social media. If you do need to cancel a class, the following fee structure will apply:

  • Early cancel ($0): If you cancel your booking a minimum of 5 hours before the scheduled start time, you won’t forfeit the session, or pay a fee. 

  • Late cancel ($5): Last minute change of plans? If you cancel within 5 hours of the class start time, unfortunately you will forfeit the session, and be charged a cancellation fee of $5.

  • No-show ($10): If you don’t cancel your class prior to the start time, and don’t attend, you will forfeit your session and be charged a cancellation fee of $10. Being late is also considered a no-show. 

Intro Offers

Our intro offers are only available on your first visit to the studio and once only. They cannot be suspended for any reason.

The activation date is the date of the first class booked or attended on that pass/offer.

Potentia Pilates Studio’s class Intro Offer of Unlimited Classes for 30 Days is valid for 30 days from the date of the first class booked, and will expire thereafter. 

Our Sauna Intro Pack Offer of three sauna sessions for $99 is valid 90 days from the date of your first session booked and will expire 90 days thereafter. 

Clients found to be purchasing any intro offers more than once will be suspended and charged any additional costs they may have incurred.

Class Packs

Potenita Pilates Sauna & Reformer Class Packs (excludes intro offers).expire after 12 months.

Potentia Pilates does not offer refunds, transfers, suspensions or extensions on  class passes for change of mind, injury, illness, change of address or any other reason. All purchases are final

Passes cannot be shared. Anyone found to be sharing their pass will be denied entry and have their pass or membership canceled.

Class Packs and memberships exclude attendance at guest teachers classes, workshops and special events.

Memberships

The minimum term of the Unlimited, Half, Mini & Student membership is 16 weeks (minimum term) and you may not cancel or terminate any of these Memberships before that date for any reason whatsoever. If you suspend your membership during this initial period, the Minimum Term will be extended by the period of the suspension.

The term of the Unlimited, Half, Mini or StudentMembership commences on the date specified above as the start date of this the clients contract contract.

The Unlimited Membership allows you unlimited access to regularly scheduled Reformer Pilates and one sauna session per week. 

The Student Membership allows you unlimited access to regularly scheduled Reformer Pilates. Failure to provide a valid Student Card lil result in termination of membership. There will be no refunds. 

The Half Membership allows you access to x3 regularly scheduled Reformer Pilates classes per week.

The Mini Membership allows you access to x2 regularly scheduled Reformer Pilates classes per week.

After the expiry of the minimum term, the membership will continue indefinitely until you advise Potentia Pilates via email (hello@potentiapilates.com.au) that you wish to terminate the membership. 3 business days is required to process any such termination.

You may suspend your membership by emailing us at hello@potentiapilates.com.au to notify us of the dates of the suspension no later than 3 business days before the start of the suspension period. You may suspend your Membership for a minimum period of 2 weeks and for a maximum period of 6 weeks at one time. Over 12 months, the total number of weeks you may suspend is 12 weeks.

Membership fees will charged to your credit card or bank account weekly by a third party biller.

From time to time Potentia Pilates may alter its fees. Notice of any such increase will be provided at www.potentiapilates.com.au and via email. Your Membership fee will change accordingly, with such increase to take effect not less than 2 weeks after the date that the increase of fees is notified on the website.

It is your responsibility to ensure there are sufficient funds available to cover the fortnightly auto debit. If any auto debit is declined due to insufficient funds, the transaction will fail which may yield additional bank costs. Any bank fees incurred from insufficient funds will be debited from your nominated account after the failed payment.

Potentia Pilates is in no way responsible for additional bank fees that you many incur from your bank. Bank fees are under the terms and conditions of contractual agreements between you and your bank.

If an auto debit cannot be made for any reason, Potentia Pilates may in its absolute discretion, process payment any time after the due date upon receipt of sufficient monies in your account.

If auto debit payments fail for 2 payments or more, Potentia Pilates may in its absolute discretion cancel the membership.

I agree with the above terms and conditions.

We collect personal information for the purposes of delivering our products and services and communicating to our customer.

In this section this Policy describes which personal information we collect about you as our customers and how we use and store it for your protection. Personal information is any information or opinion in any form, which identifies an individual or from which an individual’s identity is apparent or can be reasonably ascertained. By using this website and giving your information to us you indicate your consent to us and any other organisations third party suppliers and agents we engage or employ from time to time, to collect and use your personal information in accordance with the terms set out in this policy.

What information do we collect? This will depend on who you are (customer or supplier) and the nature of your interaction with us. This may include your full name, billing information and other personal information. If you do not provide us with the required information we request then we may not be able to deliver our services.

Potentia Pilates will seek to take all reasonable steps to keep any information we hold about you, secure, accurate and up to date. Your information is stored on secure servers and we will take all reasonable steps to ensure that our employees and contractors respect the confidentiality of any personal information held by us. You should notify us immediately if there is any unauthorised use of your account or any other breach of security. Potentia Pilates does not accept responsibility for any consequences of the unauthorised access to your information.

We may amend this privacy policy form time to time and the current version will be published on our website. From time to time we may include links to other websites however do not accept responsibility for the safety and security once you leave our secure site.

DISCLAIMER

Disclaimer

You should always consult your physician or other healthcare provider before changing your diet or starting an exercise program.

I understand that there is a risk of injury associated with participating classes at Potentia Pilates.

I hereby assume full responsibility for any and all injuries, losses and damages that I incur while attending, exercising or participating in classes Potentia Pilates.

I hereby waive all claims against Potentia Pilates, its instructors, or partners of individually or otherwise, for any and all injuries, claims or damages that I might incur.

I understand and agree that I am in good physical condition and that I have no disability, impairment or ailment preventing me from engaging in active or passive exercise that will be detrimental to heart, safety, or comfort, or physical condition if I engage or participate

I agree with above terms and conditions.

INFORMED CONSENT & LIABILITY WAIVER

  1. By attending Potentia Pilates and participating in classes, you will be performing physical activity and exercise which has an inherent risk of personal injury. Participating in Classes is undertaken at your own risk.

  2. You must inform instructors if there are any risks to your health by participating in Class, including in a Class, such as if you have a pre-existing injury, illness, muscle soreness/discomfort or are pregnant, prior to commencement. Participating in any form of exercise at Potentia Pilates with a Medical Condition is done entirely at your own risk.

  3. You acknowledge that your participation in any form or exercise at our studios may involve risks, including risk of personal injury. I understand I am not obliged to perform, nor am I obliged to participate in any activity that I do not wish to do, and that it is my right to refuse such participation at any time during classes. I will inform Potentia Pilates of any symptoms or concerns before, during and after session participation. 

  4. Potentia Pilates instructors and studio staff are not medically trained and are therefore not qualified to assess whether clients are in good physical condition and/or that clients can engage in exercise without detriment to their health, safety, comfort or physical condition. Clients are advised to seek medical advice prior to commencing any exercise program if they are in any doubt about their ability to engage in exercise. 

  5. By participating in our classes, you agree that our liability in relation to recreational services (as that term is defined in section 139A of the Competition and Consumer Act 2010 (Cth)) for any death, physical or mental injury (including aggravation, acceleration or recurrence of any such injury), the contraction, aggravation or acceleration of a disease, the coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behavior, course of conduct or state of affairs that is or may be harmful or disadvantageous to you or the community, or that may result in harm or disadvantage to you or the community, that may be suffered by you as a result of the supply of recreational services by Potentia Pilates is hereby excluded, save that this limitation of liability does not apply to significant personal injury suffered by you as a result of reckless conduct by Potentia Pilates in supplying the recreational services. 

  6. You acknowledge that our instructors may use tactile cueing and adjustment methods, or make physical contact with you for correction, safety & guidance purposes in order to ensure that your Pilates practice is undertaken in accordance with Potentia Pilates best practice. This is always done in a respectful and professional manner. Please discuss with your instructor if you have any concerns about this policy.

  7. Pregnant Clients: Potentia Pilates can accommodate pregnant clients in all classes unless you are experiencing complications in your pregnancy. If you are new to reformer Pilates or fitness, we highly recommend clearance from your doctor, women’s health physio or OBGYN to participate in classes.
